We have represented a number of Canadians injured in New York. These
clients were from Quebec and Ontario. A few issues come up in dealing
with Canadian clients.
The first thing most people are concerned about is the distance.
While you will not have to come to New York frequently for your case,
you may have to come a few times. We try to minimize this. For example,
two parts of the process are the depositions and the independent
medical examination (IME) - where the other side's doctor examines you.
In most cases these are done a month or so
apart. For clients who live at a distance, we try to get these
scheduled within a day of each other so our clients only have to make
one trip. If we are able to get a settlement or award on your case, you
will be reimbursed for travel expenses out of that money at the end of
your case.
Another concern is what might happen in your home province as a
result of your claim here. Regarding Quebec, for example, SAAQ will try
to claim a lien against your personal injury settlement. We have dealt
with this and know how to fight to protect you from SAAQ on this.
Third, you may also be eligible for No-Fault benefits in New York,
which is generally better than what is provided in your home province.
It is also better for our handling of your case if you see a doctor in
the area where your case is pending. We can advise you on how to go
about getting medical treatment here.
