We have represented a number of out-of-staters injured here in New
York. These
clients were from Quebec and Ontario. A few issues come up in dealing
with clients from other states.
Distance is a major worry for our clients. While you will not have
to come to New York frequently for your case,
you may have to come a few times. We try to minimize this. For example,
two parts of the process are the depositions and the independent
medical examination (IME) - where the other side's doctor examines you.
In most cases these are done a month or so
apart. For clients who live at a distance, we try to get these
scheduled within a day of each other so our clients only have to make
one trip. If we are able to get a settlement or award on your case, you
will be reimbursed for travel expenses out of that money at the end of
your case.
You are also eligible for No-Fault benefits in New York,
which is generally better than what is provided in New Jersey (there is
no deductible and no co-pay). We can help you deal with your insurance
company to make sure you get your medical expenses paid. We will also
do our best to protect against any lien - where an insurance company
tries to take a part of your settlement.
