Q: How many jury trials have you had?

A: I've handled over 40 jury trials through jury verdict. Almost all of my trials have been personal injury cases. I have also had a few criminal jury trials.

Q: How long will my case take?

A: We get most cases resolved within a year, but some cases can take two years or longer. We do take some steps to get your case moving. In most cases we will only negotiate with the insurance company for a few months, and if it's not resolved we'll start a lawsuit. We also ask judges to set scheduling orders soon after the case gets going. The longer a personal injury lawyer waits at these stages, the longer it will be before you get your money. Many lawyers will wait over a year to sue your case, and will not request a scheduling order, letting your case sit for months on end.

Q: What will you do if there isn't much insurance?

A: Most personal injury lawyers will tell you there's nothing that can be done. In most cases you will not be able to get more than the insurance coverage. But when faced with low insurance, a good personal injury lawyer will press for a quick settlement. At least you should get your money sooner rather than later. In the process, we make what's known as a "bad faith record," showing our efforts to settle the case and the failure of the insurance company to negotiate in good faith. If they refuse to settle and conduct themselves improperly, that may open the door to money beyond the insurance coverage.

Another side of this is not wasting your money. Some lawyers will spend a lot of money on records and consultants. That's your money. If you have a good case and there's low insurance, your personal injury lawyer should not waste your money on unnecessary expenses.

Q: What was your biggest verdict?

A: In 2007 I won a trial with a $3.85 million verdict. Our client was sitting on his motorcycle, stopped in traffic. An SUV crossed over the centerline, driving our client into another SUV. Our client's foot was partially amputated in the accident itself, and he eventually had his leg amputated below the knee. This was one of the largest pain and suffering verdicts ever in Albany County.
